6th & Island Investments LLC, doing business as Omnia Nightclub San Diego, along with several affiliated entities, agreed to pay $7 million to settle a class action lawsuit. The lawsuit alleged the nightclub and its affiliates engaged in discriminatory practices by charging men and nonbinary individuals full price and subjecting them to security pat-downs at ladies’ night events while women received free or discounted admission and no pat-downs.

How much is the ladies' night payout?
Each eligible class member who submits a timely and valid claim form can receive a payment of up to $4,000. The actual payout may be less than $4,000 if the total number of valid claims, plus attorneys’ fees, service awards and administrative costs, exceeds the $7,000,000 settlement fund.
The calculation for each claimant’s payment is the net settlement fund (total settlement amount minus attorneys’ fees, service awards and administrative costs) divided by the number of valid claims. If the resulting amount is more than $4,000, each claimant will receive the full $4,000. If it is less than $4,000, each claimant receives a pro rata share.
