MSCHF Product Studio, Inc. has agreed to pay $309,750 to settle a class action lawsuit for allegedly sending marketing text messages to individuals after they requested not to receive further messages, in violation of the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA).

Who can submit for a TCPA payout?

Class members must meet the following criteria:

• You received more than one marketing text message from MSCHF Product Studio, Inc. within a 12-month period.
• You had previously asked MSCHF Product Studio, Inc. to stop sending you such text messages, by replying "stop" or making a similar request.
• Your telephone number appears in the call logs produced by Klaviyo, showing you were sent marketing texts after making a stop request.

How much is the class action settlement payment?

Pro Rata Cash Payment: Final payment amount will be determined by the number of claims submitted.

How to claim a TCPA class action rebate

To receive a settlement payout, class members must submit a claim form. You can file a claim online or download and print the PDF claim form to mail in. The completed claim form must be submitted online or postmarked by the deadline of May 30, 2025.

The settlement fund of $309,750 includes the following:

• Settlement administration costs: Capped at $20,000
• Attorneys’ fees and costs: Up to $125,000
• Service award to class representative: $7,500
• Payments to approved claimants: Remaining settlement funds

When is the MSCHF TCPA Settlement payout date?

Checks will be mailed to approved claimants approximately 90 days after the the court grants final approval.

Why did this class action lawsuit happen?

The lawsuit alleged that MSCHF Product Studio, Inc. sent marketing text messages to consumers after they had requested not to receive further messages, violating the TCPA and FTSA. The defendant denied these allegations, but agreed to settle to avoid the cost of further litigation.
