
Individuals who received more than one marketing text message from Goldco after asking the company to stop or opting out may be eligible to submit a claim for a cash payment from a class action settlement.
Goldco Direct LLC agreed to pay $2 million to settle a class action lawsuit alleging it sent marketing text messages to individuals after they requested not to receive further messages (opted out). The plaintiffs claim this conduct violated the Telephone Consumer Protection Act.
Who can file a TCPA claim?
Class members must meet the following criteria:
- They received more than one marketing text message from Goldco Direct LLC or anyone acting on its behalf within any 12-month period.
- Before receiving the additional messages, they requested not to receive further text messages from Goldco by replying with a “stop” or “unsubscribe” request.
- The National Do Not Call Registry listed their phone number at the time they received the messages.
- They did not re-opt in to receive text messages before receiving the additional messages
- They received the messages during the four years prior to the lawsuit filing on April 18, 2023.
How much will the settlement payment be?
Pro rata cash payment: Class members can submit to receive a pro rata cash payment from the net settlement fund. Final payment amount will be determined by the total number of valid claims filed.

To receive a settlement payment, class members can file a claim online or download and print the PDF claim form to complete and mail or email to the settlement administrator.

When is the Goldco unwanted text message payout date?
