Individuals who received notice that a June 2024 data security incident involving Clay-Platte Family Medicine Clinic P.C., Summit Family and Sports Medicine or Barry Pointe Family Care P.C. may have exposed their personal information could be eligible to claim up to $15,000 from a class action settlement.
Clay-Platte Family Medicine Clinic agreed to pay $1 million to resolve a class action lawsuit claiming a data breach exposed the sensitive personal and health information of nearly 54,000 individuals. The lawsuit alleged the defendants failed to adequately protect patient data, leading to unauthorized access by cybercriminals.
Who can file a claim?
The class includes all living persons residing in the United States who received notice from Clay-Platte Family Medicine Clinic, Summit Family and Sports Medicine or Barry Pointe Family Care that the June 2024 data breach potentially compromised their personal information. This includes both current and former patients.
The compromised information may include:
- Names
- Social Security numbers
- Dates of birth
- Addresses
- Confidential medical information
- Gender
- Telephone numbers
How much can class members receive?
Class members may claim one or more of the following benefits, depending on their circumstances and preferences:
- Reimbursement for documented out-of-pocket losses: Class members may submit a claim of up to $15,000 to cover expenses related to the data breach, such as identity theft or fraud, credit monitoring purchased after June 26, 2024, professional fees and other related expenses. Supporting documentation is required.
- Pro rata cash payment: Class members who do not have documented losses may choose a cash payment. The settlement administrator will divide the total available funds for this option among all eligible claimants who select it.
- Free medical and credit monitoring services: All class members may claim three years of CyEx Medical Shield Total, which includes:
- Medical and three-bureau credit monitoring
- Dark web monitoring
- Fraud alerts
- Identity theft insurance up to $1 million
- Access to fraud resolution support
How to claim a settlement payout
Class members can file a claim online or download a PDF claim form to complete and mail to the settlement administrator. They may also request a paper claim by calling or emailing the settlement administrator.

What proof or documentation is required to submit a claim?
- All claimants must provide the notice ID from the postcard notice they received.
- Online claimants must also provide the confirmation code from the same notice.
- For documented monetary losses, claimants must provide supporting documentation, such as receipts, account statements, police reports or invoices to show their expenses are related to the data breach.
- For pro rata cash payments and credit monitoring, claimants must attest they are a class member and have not opted out.

Class members can choose from the following payment methods:
- PayPal
- Venmo
- Zelle
- Paper check
If eligible class members do not select a payment method, the settlement administrator will send a paper check to the address they provided.
$1 million settlement fund breakdown
The $1,000,000 settlement fund will cover:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $333,300
- Service awards to named plaintiffs: Up to $2,500 each ($32,500 total)
- Credit monitoring services: Cost determined by the number of valid claims for this option
- Payments to eligible class members: The remainder of the settlement fund

Why did this class action settlement happen?
The class action lawsuit alleged that on or around June 26, 2024, cybercriminals accessed the defendants' servers and obtained the sensitive personal and medical information of nearly 54,000 patients. The plaintiffs claimed the defendants failed to adequately protect this information.
The defendants deny wrongdoing but agreed to settle to avoid the risks and costs of continued litigation. As part of the settlement, the defendants will also implement improved data security practices for at least five years.
