Bath & Body Works, LLC and Victoria’s Secret Stores, LLC have agreed to pay $3,000,000 to settle a class action lawsuit for alleged violations of the Fair and Accurate Credit Transactions Act (FACTA). This settlement provides eligible consumers with vouchers worth up to $15 for purchases at Victoria’s Secret, PINK, or Bath & Body Works stores.

Who Benefits? All consumers who made a purchase at a Victoria’s Secret, PINK, or Bath & Body Works store between May 10, 2021, and August 8, 2021, and received a printed receipt displaying more than the last five digits of their credit card or debit card number.

How much can I get? Eligible consumers can receive one voucher worth up to $15.00 for each purchase made during the relevant period.

Can I Claim an Award?

To be eligible for an award, you must be a consumer who made a purchase at a Victoria’s Secret, PINK, or Bath & Body Works store between May 10, 2021, and August 8, 2021, and received a printed receipt displaying more than the last five digits of your credit card or debit card number. This includes purchases made at any of the three stores during the specified period.

If you made multiple purchases at both Bath & Body Works and either Victoria’s Secret or PINK during the relevant period, you may submit claims for each store and receive up to two vouchers, one for each store. However, you are entitled to receive only one voucher per store, even if you made multiple purchases at that store.

Who is Excluded?

Excluded from the Class are Defendants’ Counsel, Defendants’ officers and directors, Class Counsel, the judge presiding over the Action and any member of the judge’s immediate family, and any heirs, assigns, and successors of any of the above persons or organizations in their capacity as such. Also excluded are individuals who commenced separate litigation or arbitration involving FACTA against any Defendant before the execution of the Settlement Agreement.

What Can I Claim?

Defendants have agreed to provide each eligible Settlement Class Member who timely and validly completes and submits a Claim Form with one voucher worth up to $15.00 to use on any single purchase at a Victoria’s Secret, PINK, or Bath & Body Works store.

If you submit a claim for a purchase made at Victoria’s Secret or PINK, you will receive a voucher usable only at either of those stores. If you submit a claim for a purchase made at Bath & Body Works, you will receive a voucher usable only at Bath & Body Works.

Is Proof Required to Claim the Reward?

Yes, proof is required to claim the reward. You must complete and submit a Claim Form, which is available on the official settlement website. The Claim Form may be submitted electronically or by postal mail.

How to Claim Your Award

To claim your award, you must complete and submit a Claim Form by July 16, 2024. The Claim Form is available on the official settlement website and can be submitted electronically or by postal mail. For more details, visit the Official Claim Form.

Read the instructions carefully, fill out the form, and postmark it by July 16, 2024, or submit it online on or before 11:59 p.m. (Eastern) on July 16, 2024.

$3,000,000 Settlement Fund

The settlement amount is $3,000,000. This amount will cover the cost of the vouchers, attorneys’ fees, and other expenses related to the settlement.

The settlement amount was agreed upon by both parties to avoid the cost of a trial and to provide relief to the Settlement Class Members now rather than years from now.

Why is There a Class Action Settlement?

The class action settlement was reached because the Named Plaintiffs alleged that the Defendants printed more than the last five digits of credit card and debit card numbers on receipts provided to cardholders at the point of sale in their Victoria’s Secret, PINK, and Bath & Body Works stores, in violation of the Fair and Accurate Credit Transactions Act (FACTA).

The Defendants deny any wrongdoing or liability, and no court has made any judgment or determination of liability. Both sides agreed to the settlement to avoid the cost of a trial and to provide relief to the Settlement Class Members.
