Jackson National Life Insurance Faces Multi-Million Dollar Lawsuit Over Data Breach

On a seemingly ordinary day in July 2023, Michael Heinz, a customer of Jackson National Life Insurance Company, discovered that his personal information, along with that of countless others, had been compromised. This marked the beginning of a legal battle that would bring to light allegations of negligence, violation of federal and state statutes, and failure to comply with industry standards.


Heinz alleges that the insurance company failed to properly secure and safeguard customers' sensitive information, including full names, dates of birth, and Social Security numbers. This negligence, he claims, led to a cyberattack and data breach, leaving customers vulnerable to identity theft and financial fraud.


"The defendant failed to encrypt or redact the sensitive information, making it vulnerable to unauthorized access," the complaint reads. This alleged failure is particularly concerning given the prevalence of cyberattacks targeting insurance companies. As a software engineer, Heinz understands the importance of robust data security measures and the potential consequences of their absence.


The lawsuit claims that Jackson National Life Insurance Company violated the Class Action Fairness Act, the Gramm-Leach-Bliley Act, and Federal Trade Commission (FTC) guidelines. The Gramm-Leach-Bliley Act, for instance, requires financial institutions to explain their information-sharing practices to their customers and to safeguard sensitive data.


Moreover, the FTC guidelines mandate that companies must have reasonable security measures in place to protect sensitive customer information. If the allegations are proven true, the insurance company's failure to encrypt or redact the sensitive data could be seen as a violation of these guidelines.


The complaint also alleges that the defendant's negligence resulted in invasion of privacy, lost time, and opportunity costs associated with mitigating the consequences of the data breach. It further claims that customers suffered a loss of benefit of the bargain due to the data breach.


"Actual injuries and damages suffered by plaintiffs include invasion of privacy and loss of productivity," the complaint states. It also highlights the diminished value of the plaintiffs' personally identifiable information (PII) and the increased risk of identity theft and financial fraud.


Heinz is not alone in his fight. The lawsuit is filed on behalf of all persons whose PII was compromised as a result of the defendant's alleged failure to protect and secure their data. This class action lawsuit seeks to hold the insurance company accountable for its alleged negligence and failure to comply with industry standards.


The lawsuit seeks damages for the actual injuries and damages suffered by the plaintiffs, including invasion of privacy, lost productivity, and the diminished value of their PII. It also seeks compensation for the increased risk of identity theft and financial fraud that the plaintiffs now face due to the data breach.


In the wake of the data breach, Heinz and other affected customers are left to pick up the pieces, spending their time and resources to mitigate the risk of identity theft and fraud.
