Current or former TracFone Wireless customers, including Straight Talk, Simple Mobile, Net10 Wireless, Walmart Family Mobile or Total Wireless users, affected by the December 2021 data breach may qualify to claim up to $50,000 from a class action settlement.

TracFone Wireless Inc. agreed to settle a class action lawsuit claiming negligence and breach of contractual and statutory duties. An unauthorized user accessed customer information, which led to some cell phone number hijacks and service interruptions.

Who can file a claim for a data breach payout?

Class members can file a claim if:

  • They are a resident of the United States.
  • The TracFone data breach affected their information
  • They were a customer of TracFone Wireless or one of its brands, including Straight Talk, Simple Mobile, Net10 Wireless, Walmart Family Mobile or Total Wireless, at the time of the December 2021 data incident.

How much is TracFone data breach settlement payout?

Eligible class members can submit for the following:

  • Ordinary Expense and Time Reimbursements: Up to $3,250 per person for documented out-of-pocket expenses and lost time.
    • Up to 15 hours of lost time dealing with the data breach at $30 per hour can be claimed.
    • Out-of-pocket expenses can include bank fees, postage costs, gas costs, and costs for credit reports, credit freezes, credit monitoring or identity theft insurance purchased between Nov. 15, 2021, and Aug. 7, 2025.
  • Extraordinary Expense Reimbursements: Up to $50,000 per claimant for documented, unreimbursed monetary losses related to identity theft, including lost business opportunity costs, that occurred between Nov. 15, 2021, and the date you the claimant regained control of their wireless account plus 30 days.
  • Credit Monitoring: Three years of one-bureau credit monitoring services, including $1,000,000 in identity theft insurance.

How to claim a data breach class action rebate

A Unique ID is required to submit a claim. If you did not receive a settlement notice and believe you are a class member, you must submit an online registration request to receive a Unique ID number by email.

To receive a settlement payment, class members must file a claim online or download and print the PDF claim form, complete it and mail it to the settlement administrator. The deadline to file a claim is Aug. 7, 2025.

TracFone settlement fund

The settlement fund covers:

  • Settlement administration costs: TBD
  • Attorneys' fees and expenses: Up to $1,400,000
  • Service awards to plaintiffs: Award amounts to be presented to the court for approval at a later date
  • Credit monitoring and identify theft protection: Cost determined by the number of claims filed
  • Payments to approved claimants: Uncapped, fees and costs listed above will not reduce individual claim payment amounts
